  • Potential Rescission of H-4 Work Permits under a Trump Presidency

The return of Donald Trump to the U.S. presidency raises significant concerns for H-4 visa holders, particularly spouses of H-1B visa holders. Under the 2015 EAD (Employment Authorization Document) rule introduced by the Obama administration, eligible H-4 visa holders were granted work permits, allowing them to contribute to the economy and access financial and personal benefits, such as obtaining a Social Security number, a bank account, and a driving license. For many Indian families, this was not just about financial stability but an essential part of integrating into American society.

During Trump’s previous tenure, his “Buy American, Hire American” executive order proposed revoking the EAD rule, creating intense uncertainty for H-4 visa holders. The Biden administration reversed this course in 2021, ensuring that H-4 spouses continued to contribute to critical sectors like technology and healthcare. If Trump reintroduces this policy, the EAD rule could again face jeopardy. If rescinded, many families—particularly Indian immigrants who face green card wait times of several decades—could be left in an unstable situation.

The EAD rule has endured legal challenges from groups claiming it unfairly takes jobs from American workers, yet it has remained intact. However, if Trump reintroduces policies prioritizing U.S. workers, as many anticipate, H-4 spouses could once again lose their right to work, placing Indian families in a precarious position.
